The very act of creating a regulator creates a target for capture — the more specialized the regulator, the fewer people understand its domain, and the more dependent it becomes on the industry for expertise. This means well-intentioned regulation can paradoxically strengthen the incumbents it was meant to constrain, turning the referee into a player on the team.
